CRIMINAL ACTS AGAINST JUDICARY IN LIGHT OF AMENDMENTS IN 2009

Summary

In this paper the author discusses novelties which were brought to the group of crimes against judiciary by the Law on Amendments to the Criminal Code which was enacted in 2009. There are the following alterations and amendments: a) more severe penalties were prescribed in a number of crimes, b) appropriate technical and terminological corrections were carried out in several criminal acts and c) two new criminal offenses were prescribed: unauthorized public commenting on court proceedings (Article 336a of Criminal Code) and obstruction of justice (Article 336b of Criminal Code). In this paper, special attention is paid to the analysis of important characteristics of being of newly introduced crimes. After critical analysis, the author carries out conclusions regarding certain issues discussed in the paper, supported by appropriate arguments.
