LIABILITY FOR MATERIAL DEFECTS OF THINGS

Summary

In this paper we will talk about the terms of responsibilities, rights of the acquirer and the contract extension, limitation and exclusion of liability for material defects of things. The basic subjects of consideration are provisions of the Law on Obligations with a focus on solutions that are accepted in comparative law. As the reform of the law of obligation is in process in Bosnia and Herzegovina, and since one of the reasons for the adoption of the new Law on Obligations is the need to harmonize this area with European law, special attention herein is devoted to solutions provided by the Directive 1999/44/EC of the European Parliament and of the Council of 25 May 1999, on certain aspects of the sale of consumer goods and associated guarantees.
