INHERITANCE OF COPYRIGHT

Summary

A subjective copyright is exclusive right which consists of moral and economic rights. The main goal of copyright is to protect personal and property interests of the author. Like most of the intellectual property rights, copyright is limited and lasts for 70 years after the author’s death. What happens to the copyright after the author’s death is one of the most interesting questions in the theory and practice. Copyright is inheritable in Bosnia and Herzegovina, although it cannot be transferred during the author’s life. However, the existence of moral and economic rights affects on the scope and content of copyright which is acquired by heirs. There is limited number of legal heirs of copyright in the Law of inheritance of Bosnia and Herzegovina. Only children, parents and spouse can inherit author’s rights. If the author doesn’t leave the will and there are no legal heirs, state will inherit copyright. The paper deals with specific regulation of inheritance of copyright in Bosnia and Herzegovina.
